About these Terms
These Terms and Conditions apply to your purchase of and participation in The Loft.
By purchasing access to The Loft, you agree to these Terms and Conditions.
These Terms may be updated from time to time to reflect changes to the program, my business, or legal requirements. The version in force at the date of your purchase applies to your membership. Where a change would materially affect your existing access, I will let you know.
You must be 18 years or older, and have the legal authority to enter into this agreement, to purchase access to The Loft.

Access to The Loft
Your purchase provides you with six (6) months' access to The Loft, beginning on the date your enrolment is activated.
Your membership includes access to all content available within The Loft during your access period, including any updates or additional resources added during that time.
At the end of your six-month access period, your membership will expire unless otherwise agreed in writing.

Eligibility
The Loft has been developed for parents and caregivers seeking educational support in relation to raising neurodivergent children.
You are responsible for deciding whether the program is suitable for your family's circumstances before purchasing.
If you are unsure whether The Loft is the right fit, please contact me before enrolling. I am happy to answer questions about the program or discuss whether another service may better meet your family's needs.

Payment
Payment must be received before access to The Loft is provided.
Where payment plans are offered, you agree to make payments in accordance with the agreed payment schedule.
If payments are not made as agreed, access to The Loft may be suspended until the account is brought up to date. Your six-month access period continues to run during any suspension for non-payment; suspension does not extend your access period.
All prices are listed in Australian dollars (AUD).
GST will be applied where required under Australian law.

Access and Account Security
Your membership is intended for a single household only.
Your login details are personal and must not be shared with people outside your household.
You are responsible for maintaining the confidentiality of your username and password and for any activity occurring under your account. If you believe your account has been accessed without your authorisation, please contact me as soon as possible so we can secure it together.

Intellectual Property
All videos, written content, downloadable resources, worksheets, templates, graphics and other materials within The Loft remain the intellectual property of Emma Richards Psychologist Pty Ltd unless otherwise stated.
Your purchase provides you with a licence to use these materials for your own personal learning and implementation within your family.
You may not:
reproduce or copy program materials
distribute or share program materials with others outside your household
upload program materials to other websites or platforms
sell, adapt or commercially use any Loft resources
present Loft materials as your own work
share your login details with another person.
If you would like permission to use Loft materials for another purpose, please contact me.

Program Updates
The Loft will continue to evolve over time.
Content may be updated, expanded, reorganised or replaced to reflect developments in professional knowledge, program improvement, or my ongoing practice.
These updates form part of your membership and do not extend your access period.

Platform Availability
Reasonable steps will be taken to keep The Loft available and functioning as intended.
Occasionally, access may be temporarily interrupted due to scheduled maintenance, software updates or circumstances outside my control. Where possible, interruptions will be kept to a minimum and, where practical, scheduled maintenance will be communicated in advance.
If a significant interruption prevents you from accessing The Loft for an extended period (more than 7 consecutive days), please contact me — I will consider an extension to your access period to reflect the time lost.

Personal Responsibility
The information provided throughout The Loft is intended to support reflection and thoughtful decision-making.
Families are complex, and there is rarely a single strategy that works for every child or every situation.
You remain responsible for deciding how and whether the ideas presented within the program are applied to your own child, family and circumstances.

Individual Services
Your Loft membership does not include:
individual psychological advice
psychological assessment
review of your family's individual circumstances
personalised recommendations
email consultation
ongoing clinical support or monitoring.
If you would like more individualised support, separate services, including parent consultations and the Personalised Loft Roadmap, are available and are subject to their own consent processes, fees and service agreements.

Refunds
Because The Loft provides immediate access to digital content, all sales are final once your access has been activated, except as set out below or as required under the Australian Consumer Law.
Change of mind: As access to program content is granted immediately upon payment, refunds will not be provided for change of mind once your membership has been activated.
Access or technical issues: If you experience a technical issue that prevents you from accessing The Loft, please contact me as soon as possible. I will work with you to resolve the issue, and where it cannot be resolved, a refund or extension of your access period will be offered.
Your rights under Australian Consumer Law: Nothing in this policy limits or replaces your rights under the Australian Consumer Law. Where The Loft is not delivered as described, is not reasonably fit for its intended purpose, or otherwise fails to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law, which may include repair, replacement or refund.
If you experience any difficulties accessing the program or have concerns about your purchase, please contact me as soon as possible so we can work together to resolve the issue.

Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
Where required under Australian Consumer Law, appropriate remedies, including repair, replacement or refund, will be provided.

Suspension or Termination of Access
Access to The Loft may be suspended or terminated if:
these Terms and Conditions are seriously breached
program materials are shared without permission
another person's account is used, by you or with your knowledge, without authorisation
behaviour within any Loft community or live event is abusive, threatening, discriminatory or inappropriate.
Where appropriate, I will endeavour to discuss concerns with you before suspending or terminating access.
If your access is terminated for a breach on your part, no refund will be provided for the remaining access period. If I terminate your access for reasons unrelated to any breach on your part, I will provide a pro-rata refund for the remaining access period, unless otherwise agreed with you.

Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, my liability for any loss arising from your use of The Loft is limited to the amount you paid for your membership.
The Loft provides general, educational information and is not a substitute for individual psychological advice, assessment or treatment.

Privacy
What I collect: To provide you with access to The Loft, I collect personal information such as your name, email address, contact details, and payment information. Payment information is processed securely by my third-party payment provider and is not stored by me directly.
Why I collect it: This information is used to activate and manage your membership, communicate with you about your access, and meet my legal and accounting obligations. I do not use your information for purposes unrelated to your membership without your consent.
How it's stored: Your information is stored on secure, password-protected systems. Reasonable steps are taken to protect your personal information from misuse, loss, unauthorised access, modification or disclosure.
Disclosure to third parties: Your information is only shared with third parties where necessary to deliver The Loft (for example, my payment processor and the platform hosting provider) or where required by law. I do not sell or trade your personal information.
AI-assisted documentation: The Loft itself does not involve the use of AI-assisted documentation. If you later purchase a Personalised Loft Roadmap or another individual service that uses AI-assisted documentation, separate consent will be obtained before AI is used.
Access and correction: You may request access to the personal information I hold about you, or ask me to correct it, at any time by contacting me.
Retention: Your personal information is retained for as long as needed to provide your membership and to meet legal, accounting and insurance obligations, after which it is securely destroyed or de-identified.
Complaints: If you have a concern about how your personal information has been handled, please contact me first so we can resolve it directly. If you are not satisfied with my response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
This handling of personal information is consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

I want you to feel informed and comfortable about participating in The Loft.
If you have any questions about these Terms and Conditions, your membership, or whether another service may better meet your family's needs, please contact me. I am happy to discuss the program and answer any questions before or during your participation.

General
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
These Terms and Conditions form the entire agreement between us in relation to The Loft.

Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia.

Agreement
By purchasing access to The Loft, I acknowledge that:
I have read and understood these Terms and Conditions.
I am 18 years or older and have the legal authority to enter into this agreement.
I understand that my purchase provides six (6) months' access to The Loft.
I understand that my membership is intended for use by my household only.
I agree not to reproduce, distribute or share Loft materials or my login details without permission.
I understand that individual psychological services are not included in my Loft membership.
I understand that refund requests will be considered in accordance with the Refunds section of these Terms and my rights under Australian Consumer Law.
I have had the opportunity to ask questions before purchasing.
I agree to participate in accordance with these Terms and Conditions.
